Seller Terms and Conditions

Effective Date: 1 Jan 2025

These Seller Terms and Conditions (“Agreement”) govern your participation as a seller on MODCART.CO, a fashion marketplace operated by Modcart Ecom Private Limited. By registering as a seller and using our platform, you agree to abide by these terms.

1. Seller Onboarding and Eligibility

  • Sellers must be legally registered entities in India (Proprietorship, Partnership, LLP, or Private Limited Company).
  • Submission of valid KYC documents including GSTIN, PAN, and address proof is mandatory.
  • Sellers must provide accurate bank details and business information.

2. Product Listings and Content

  • Sellers must upload genuine, accurate product descriptions, specifications, and high-quality images.
  • Counterfeit, prohibited, or misrepresented items are strictly banned.
  • Sellers are responsible for updating stock status and pricing in real-time.

3. Order Fulfillment

  • Sellers must process and dispatch orders within the specified handling time (typically 1–2 business days).
  • Sellers must pack products securely to prevent damage during transit.
  • Tracking information must be provided promptly.

4. Shipping and Returns

  • Modcart may provide logistics support or allow self-shipping based on the agreement.
  • Sellers must accept returns as per the platform’s Returns and Warranty Policy.
  • In the event of returns due to product fault or misdescription, the seller bears the cost.

5. Commission and Fees

  • Modcart will charge a commission on each sale, as agreed upon in the seller registration agreement.
  • Additional charges may include shipping, payment gateway, and handling fees.
  • All charges will be deducted before remittance of seller payments.

6. Compliance and Liability

  • Sellers must comply with all local, state, and national laws including those related to GST, packaging, labeling, and consumer protection.
  • Sellers are solely responsible for the legal compliance and authenticity of the products sold.

7. Intellectual Property

  • Sellers must not list or sell products that infringe on trademarks, copyrights, or patents of third parties.
  • Modcart reserves the right to delist products or suspend accounts in case of IPR violations.

8. Termination and Suspension

  • Modcart may suspend or terminate seller accounts in cases of:
    • Repeated order cancellations or delays
    • Sale of counterfeit or restricted products
    • Fraudulent activity or breach of policy
  • Sellers may also request account termination with a 14-day written notice, subject to clearance of all dues.

9. Dispute Resolution

Any disputes between Modcart and the seller shall be governed by Indian laws and subject to the jurisdiction of courts in New Delhi, India.

10. Policy Updates

Modcart reserves the right to amend these terms from time to time. Sellers will be notified via email or dashboard notifications about any such changes.
